Dear Members and friends,


Excellent freedom of speech news from the state of Washington this month!
Kudos to all our local members who helped out... Also, there is some
thought-provoking news about game developers suing for overwork. You can
read the details below, but both of these topics tie into something I've
been meaning to mention...


Most IGDA members think of the IGDA as being primarily about community -
chapter meetings, for example. And community is indeed half of our mission
-- but many overlook the other half: advocacy. In other words, the IGDA
works hard to address problems facing the community of developers, problems
that no single individual or company could solve alone.


Right now, the IGDA is working on several issues: censorship, business and
legal affairs, credit and recognition, diversity, quality of life, and
relations with academia. Want to help out with these things? Or, maybe you
know some other relevant issue the IGDA should be working on? Crunch time

Lobbying Update: Washington-State Bill HB1009
---------------------------------------------
On July 15th, 2004, the U.S. District Court in Seattle granted summary
judgment to overturn Washington state bill 1009 which was set to regulate
certain videogames, ruling the legislation unconstitutional. The decision
once again affirms that video games are protected speech. HB 1009 would
have banned minors from purchasing video games that depicted violence
against law enforcement officers (claiming that the playing the games
causes increased aggression and violence in children and young adults). The
Court found that the "legislature's belief that video games cause violence,
particularly violence against law enforcement officers, is not based on
reasonable inferences drawn from substantial evidence."


The IGDA was a joint-plaintiff, along with the ESA, IEMA and other industry
organizations who contested HB 1009 as an attack on game creators' ability
to express their ideas.

Lack of Quality of Life Ever Present...
---------------------------------------
On Monday, June 28th, a programmer in the video game industry sued media
and telecom giant Vivendi Universal, claiming he and his colleagues were
regularly forced to work extra hours and denied overtime pay. In recent
months, several lawsuits have been filed in California by tech employees
seeking to be classified as overtime-eligible and obtaining compensation
for working more than 8 hours a day, or 40 hours a week.


It is sad, but not surprising, to hear of a game industry lawsuit like
this. Further, this is only one aspect of the often severe working
conditions in our industry leading to early burnout, wasted resources and
poor quality games.


The IGDA's recent Quality of Life White Paper points to many productive
ways that developers and publishers can improve conditions in their
companies and potentially prevent such issues from arising to the level of
litigation.

- SIGGRAPH: We'll be hosting a "birds of a feather" gathering for all game
developers at the show



- Leipzig Games Convention: Board member Bob Bates and program director
Jason Della Rocca will be lecturing in the developer program.



- CEDEC: The IGDA's Japanese chapter will be hosting an Academic Day during
the first day of the CESA Developers Conference.



- Video Game Developers Summit: The IGDA's Chicago chapter is working with
a local animation festival to host a local developers conference.
