GamePolitics.com: Will Digital Distribution Make ESRB Ratings Obsolete?

Today's GamePolitics.com raises an interesting question:

Will digital distribution of video games render the ESRB ratings - and game content legislation aimed at the retail level - obsolete?

The article specifically discusses Lula 3D. Very, very few AO games actually go though the process of an ESRB rating, unless they want the rating for marketing purposes or as part of an overall corporate policy. The AO rating is a door-closer for major retail. So, from the perspective of many commercial and indie adult developers, if you're not going to sell at retail, why waste the money on the rating?
